I don't agree with you. There have been numerous homebrew games created to be sold in the past few years.

Unlicensed games were typically created by a company. Homebrew games, despite being unlicensed, aren't always. I think the big distinction is "was it mass produced?" Homebrew games aren't printed in large numbers.

That still won't fit the criteria. Pier Solar has been sold, has probably the heaviest DRM of any Mega Drive game in history, the developers formed a company just for it (and now they're making more games) and yet it's still called homebrew, just because of the people who made it. Also where it's true each run was a (relatively) small print, put all the rereleases together and it stops looking so small (and let's not get into the Kickstarter to make HD ports...).

Homebrew is pretty much just a label given arbitrarily. It's about as useless as indie at this point, since it has no hard definition.

There's also the matter of context. For example, if the person/group made it purely for the sake of getting money by tricking ignorant people by stealing copyrighted characters/names, versus if they made it for the sake of the challenge of creating a pure, old-fashioned SNES game.

I'm not disagreeing with this. I'm just saying that not all homebrew games are made to be sold.

I think there's a lot of games in history. I think if we were to include freeware games, it'd be okay. Same with some shareware (Crystal Caves, Pickle Wars and Jill of the Jungle's first episodes were technically free.)

But I think they'd need to have been fully completed, with some notability. Stuff like Cave Story or Yume Nikki, Spelunky, would all fit these.

I guess part of the problem is, the only real difference between pirate games and homebrew/fan hacks is whether they were made with the intent of making a cool game/hack, or of selling it in flea markets to unsuspecting parents who can't tell it from the real thing. Some particularly special people have been known to take other peoples' hacks/homebrews and sell them on cartridges. The line is very blurry, and in any case not terribly helpful since we want to cover games from both sides.

I don't think Smart Mouse was made to fool anybody (stolen music aside), yet nobody would consider it homebrew because it comes from the same place where most of those pirate games come. So yeah, that last definition also fails to meet it. The label is as arbitrary as it can get, the only thing in common is "the platform owner didn't explicitly approve it" (sorta... e.g. the Mega Drive has several unlicensed games such as Accolade's early games that nobody generally lumps into the unlicensed category).

Seriously, homebrew is a completely arbitrary label given only because if people consider you a "homebrewer" or not. I'm not sure TCRF can afford to go with such a vague meaning, besides we already have an unlicensed category.
