If that is true, that totally nukes the point of both stories. I don't believe one side is 'totally right' or 'totally wrong', but if your assumption was correct, not only would the articles be skewed, lie-filled journalism, but also not really news to begin with. Because we already know about that part.

Because of GuyPerfect, I did some more Googling:

"Once Defendant converted Plaintiffs’ recording into the compressed .mp3 format and they are in his shared folder, they are no longer the authorized copies distributed by Plaintiffs."

Apparently the guy was indeed uploading to Kazaa. Funny how the article left that out, regardless of how that quote could be interpreted...

I wouldn't be surprised, however, if the RIAA was taking a case where the defendant was sharing, but is attempting to use that to argue that all copying is wrong, using a case where fair use won't really apply so that they can get a precedent they can use against others- but perhaps I'm falling too much into conspiracy here.

Which shared folder? Windows Shared Folder, or a P2p Program(s)?
