Yeah, that seems silly. I got a notification on my 3DS about the ambassador program today and it said the same thing. I know they want to provide an incentive to people to get/have had 3DSes, but having games that some people just will never get to have is lame. Maybe if they wait a year or so to release those games on virtual console, it'd make sense, since that might be enough incentive.

The NES selection seems kind of weak from what they've said, though.

Balloon Fight, Donkey Kong Jr and Ice Climber are mostly just small arcadey minigame kind of things. Not much interest there.

SMB, Legend of Zelda: Who hasn't played these a million times? I used to play LoZ on my DS Lite using a flashcart (and I believe there was a version for GBA.).

They should kind of "dig in to the vault" a bit, and give people some interesting games. The GBA selection struck me as similar, but not quite as bad.

If you read the notification, it seems to indicate, albeit vaguely, that the GBA games might not be free. It just said that they would be provided, but doesn't mention "at no charge" like with the NES games. So it might just be that if you're eligible, you can get the games, but you might still have to pay for them, but then other people will not be able to get them at all.
