Just ask this guy, who's being extradited from the UK because his website links to other sites that host copyrighted materials. Even though it's not hosted in the USA or anything of the sort. You can be arrested for breaking US copyright law even if you're nowhere near the US and your operation has nothing to do with it.

Well, the US does control .com, .net, and .org- an artifact of the era the internet was created in, but such is life... (and an international body controlling them would have all sorts of its own problems)

But even so, jurisdictional control of the domain name seems quite a different thing than control of the server. (And the site is the server, in a very real sense...)

Really, all that matters is the kind of extradition rights the companies countries give eachother. If it's really good rights, then you may as well watch out for this sort of thing. I wouldn't be surprised if the US could basically extradite anyone it felt like as long as they violated a US law in this fashion. It'd just be impractical due to all the people fighting the hearings.

I get the unfortunate impression this has some fringe legal merit. Isn't much of the internet backbone located in the US? If so a massive percent of the world's infringing traffic would at some stage travel through servers on US soil.

Well, I mean, it's universally accepted that .com (and .net and .org) are US domain names, under US jurisdiction. So that's what the grounds for their claim are, as far as I can tell.

But I don't know- a DNS record just points to a server, after all.

IIRC, didn't the US get to keep jurisdiction of those domains (and the root servers) because they pledged to operate them without forcing US law on foreign interests through the domain name system?
