BREAKING NEWS!


Judge Walker has ruled that Proposition 8 violates the United States Constitution. More soon! (see court page)

Edit: I got this from a live video ... the court page hasn't been updated but what I've heard is that it was overturned under both due process and equal protection clauses of the 14th amendment to the US Constitution.

Walker decision, p.122 – “The trial record shows that strict scrutiny is the appropriate standard of review to apply to legislative classifications based on sexual orientation. All classifications based on sexual orientation appear suspect, as the evidence shows that California would rarely, if ever, have a reason to categorize individuals based on their sexual orientation. Here, however, strict scrutiny is unnecessary. Proposition 8 fails to survive even rational basis review.”


We won the whole package! Sexual orientation is a suspect class! This is enough to take down every single anti-gay law (DOMA, DADT, gay adoption bans, gay marriage bans, AND forbid anti-gay discrmination) if it becomes binding precedent. (upheld on appeal / appellate courts refuse to hear it)

Awesome, this is one step ahead for gay rights in the United States! We gave Blacks rights like 50 years ago, so we figured it's time for the LGBT people to gain our rights =D

Yay! It looks like we'll have same-sex marriage in California again soon. Hopefully it will cause a precedent, as FieryIce said. We deserve the same freedoms as straight people.

I've proposed a good idea for states that don't legalize same-sex marriage, somewhat inspired by the 21 drinking age thing in the 1980s, where they would withhold highway funding for keeping the drinking age under 21: how about withholding disaster relief funding for those states that do not legalize same-sex marriage? It'd be a great idea to get states to legalize it, since they're going to need the disaster relief funding for hurricanes, earthquakes, tornadoes, whatever...

Needless to say, I can't wait until New York legalizes same-sex marriage. Expecting that either this year or maybe 2011. =P

Oh come on Schala, we're nowhere near as politically powerful as the conservatives say we are...

45 states forbid gay marriage, that's 90 US senators that would have to vote against their own state just for our sake. Doing this the executive way would create a huge backlash and impeachment calls (perhaps even lawsuits)...

Unrelated to Prop 8 but Obama has appealed a ruling in favor of gay marriage (DOMA-related) in MA

Meanwhile, a federal judge issued a worldwide injunction Tuesday stopping enforcement of the "don't ask, don't tell" policy

Of course, it could still be appealed, but I highly doubt the ruling will be overturned by a higher court. Progress is finally coming to America! As for the DOMA ruling, I find it unnerving that Obama appealed the ruling. He has lost my vote in 2012 (at least if there are primaries).

(4) GRANTS Plaintiff Log Cabin Republicans' request to apply for
