This judge wins

So to summarize... P2P is the same thing we've done for a long time (sharing stuff), but in a different medium (digital, instead of physical) - In other words, the people running and using a site that directed users to torrent files were found to have committed no offense, and that the presence of advertising on the site (= slight monetary income) did not constitute a crime in that context. Oh, and according to the judge the decision is final and therefore cannot be appealed.

tl;dr freedom won a good victory.

Not like the USA is likely to come to such a conclusion. But yeah, I always thought it was odd how you can share physical things but often not digital ones legally. I don't violate a law if I let someone borrow a book or dress or toothbrush (although sharing a toothbrush could be a bit gross), so why should sharing my Civilization III Complete CD be a crime?

The sharing a book thing actually makes sense - although, it's more like making a copy of the book and giving it to someone else .... but I'm happy with his interpretation.

I wouldn't say that it's exactly the same as sharing a book, but it's still someone taking a better stance than "EACH DOWNLOADED COPY IS A LOST SALE!!!"

This is what happens when a Judge is not paid off by the RIAA. They can come to a sound conclusion instead of one directed by the big media moguls. While I agree with most people here, its not exactly the same as sharing a book. That would be more like sharing a CD that you bought. But this would be like sharing the book and that person copies or scans it...

Ok, enough analogies. Cudos to the Spanish judge!
