Fred Phelps’ band of attention hungry LGBT loathing Westboro Baptist Church got it in their heads that American soldiers were dying in Iraq because gay people exist, or something equally loathsome. They got in the habit of protesting military funerals, including Lance Cpl. Matthew Snyder’s funeral, who at age 20 was killed in Iraq. His father Albert Snyder sued the Westboro Baptist Church for emotional distress caused by the protesters.

Now 48 states have joined the lawsuit, which of course is centered around First Amendment concerns. The Supreme Court has agreed to hear the case. AP via Joe Sudbay.

Forty-eight states and the District of Columbia have submitted a brief to the Supreme Court in support of a father who sued anti-gay protesters over their demonstration at the 2006 funeral of his son, a Marine killed in Iraq.

Only Virginia and Maine declined to sign the brief by the Kansas attorney general.


Joe points out that Virginia’s AG is a right-wing nut and it is unclear why Maine declined to join the case.
There is nothing Westboro loves more than attention, no matter how negative, so I’m sure they are tickled pink with this news. Now if only the Supreme Court will let them be stuck with a massive amount of damages and put them out of business.

When does it stop being free speech and turn into harassment?

I mean, I'm all for protecting one of our most sacred constitutional rights, but...jeez. I also think the line has to be drawn somewhere. There must be SOME law or loophole that can be used to take these scum-suckers down.

This is my opinion exactly. Sure, technically they are protected by the first amendment's freedom of speech guarantee but that liberty must have its limits too, the guys take their shit to the extreme, I'm sure I would be horrified if my brother would have died in a war and I'd have all those nutjobs outside the funeral..

The justices are handling a very delicate subject right now...

Motorcyclists came from all over the place, and ran circles around them,
revving their engines so nobody could hear what they were saying


There were police there --
to keep locals from creating a brawl with the westboro people


and it would have happened too

We've got the law already. It is illegal to willfully disrupt a funeral here. The reason why we and the state of Maine did not join in with this would be that the resulting law would be a restriction of speech based not on action, but on the content of one's speech. There is a possibility that this law might just open the door to picking and choosing of "proper" opinions and, knowing Virginia, we would never support that.

Some people find being gay obscene.

I personally find that disrupting such private affairs with "God hates ______" obscene. Obscenities are usually very limited by the first amendment, too bad it's not up to the victim as to what is considered obscene...

Still, I'd like to see what happens when somebody pickets WBC with "God doesn't exist" signs!
