LOCKPORT, N.Y. -

Police say a western New York tow truck driver was texting on one cell phone while talking on another when he slammed into a car and crashed into a swimming pool.

Niagara County sheriff's deputies say 25-year-old Nicholas Sparks of Burt admitted he was texting and talking when his flatbed truck hit the car Wednesday morning in Lockport, which is outside Buffalo.

The truck then crashed through a fence and sideswiped a house before rolling into an in-ground pool.

Police say the 68-year-old woman driving the car suffered head injuries and was in good condition. Her 8-year-old niece suffered minor injuries.

Sparks was charged with reckless driving, talking on a cell phone and following too closely. It couldn't be determined Thursday whether he has a lawyer.

Can someone please explain to me why texting while driving hasn't been made illegal yet? It's even worse than DUI in some cases.

Shoulder use. Use left shoulder to ear, maintain driving with left arm, text with right arm to other phone.

But considering that's likely a stick-shift, he would have had to have been off the stick to accomplish that...which isn't impossible since you're not always shifting but it is not a smart thing to do when you need to slow down immediately because you'll idle out on a hard break unless you mash the clutch in time.

Well, just in case you need the assurance, VT Transporation released a study on driving while using a cell phone.

1 in 4 odds you screw up while doing such a thing, basically.

Why a study is needed to prove the obvious...is obvious...obviously people do it anyways.
