Great except either it will be too general and hit people who are doing legit high-bandwidth stuff, or it will be specific and thus, easily bypassed.

Don't they realize they're fighting a losing battle? People will always defeat their nefarious plans. The people who make these things up have far less of an incentive and an imagination than the people they're up against.
