So Square shut down the rom hack after it was in development for 5 years and at 98% completion, calling for the immediate removal, take down, deletion and destruction of all files related to the game. According to Romhacking.net's article on it, they also issued a C&D against all other rom hacks based on Square's games.

Well that definitely sucks for those who spent so much time and effort working on the game. But the whole thing might be their fault as they publicly had their disclaimer available, which outlined how Rom hacking was illegal and that it was made without Squeenix's permission and stuff so a lawyer for square could have easily found out about it all that way.

See, this is why you don't do fan projects on Squenix Games. They hate their fans.

And no...they fear profit mongering regardless of how the fans feels about it. It's no different than Konami suing a bunch of music franchises that are trying to come up and be their own (RoXoR / ITG, is the most prevalent)...or anything being sued by another or called to cease and desist - it's just business and you can't except a big company not to act on something like this.

Besides, C&D notices rarely come at a time where it's convenient for the person getting it and likely because the sting hurts that much greater and gets the point across all the more.

Fact of the matter is that you're better off developing your own game from scratch than you are making fan projects; that's always been the case...but some would rather do this anyways and they take on the risk of this happening whenever they go through with a creation of something like this. They had to be fully aware that this was possible of happening when they started the project five years ago, so I can't think they'd be totally surprised that this ended this way.

I'm not saying SE is in the right (at least, completely) but they were there with the game first...not someone that could -possibly- make a profit if left unchecked (which obviously wouldn't happen, but that's not to say someone wouldn't try).

Take a look at what happened when Epic's lawyers started going after fan art and people making one-off dolls from the Gears of War franchise. Mark Reign had to personally take control and put the lawyers back in their cage. Mark might be a giant tool, but I really do believe he was pissed off that the lawyers were attacking the fanbase.

As long as there is Japan and Final Fantasy, there will be Square Enix. It's like their version of Monty Python: only renowned coloquially while everyone else notices the rest of the world.
