On the one hand, I like what they're attempting to with this in terms of a moral perspective. Not to mention the way of dealing with people in a forum sense that like to cause trouble; this would make that something you could press charges on more than just refer to the ISP on and would keep asshole's mouths shut online.

On the other...you're running into a grey area of freedom of speech...not to mention that you're dealing online anyways which shouldn't even be taken emotionally with a grain of salt because drama llama worrying is stupid anyways...but not all people are capable of getting over it when some instances are little more than giving people a hard time but don't really mean much more than that.

This needs thrown out.

The text of the bill defines in very broad terms the kind of action that could be considered unlawful, as well as the penalties Sanchez and the supporters of the bill would like to see imposed. The text of the proposal says:

Whoever transmits in interstate or foreign commerce any communication, with the intent to coerce, intimidate, harass, or cause substantial emotional distress to a person, using electronic means to support severe, repeated, and hostile behavior, shall be fined under this title or imprisoned not more than two years, or both.

Notice the very broad terms and lack of any minimums (except in one case). Hell, intimidation could simply be me telling you to shut the fuck up or I'll ban you.

So yeah, get rid of it.


Edit: Another thing:
The judge presiding over the case is weighing a motion to nullify the jury’s verdict on allegations the authorities failed to prove Drew knew the MySpace terms of service existed — allegations that would be mooted had Drew been prosecuted under Sanchez’s proposal. Drew’s case was the nation’s first cyberbullying prosecution under the Computer Fraud and Abuse Act.

Pretty much any of the big sites out there have a very clear "I have read to and understood the terms and conditions" checkbox, required for registration. So, uh... yeah.

Besides the Constitutional issues, I just don't think there's a real need for it. This is just the result of moral panic. It's bad what happened to this girl, but this is a big country with a lot of people, there's bound to be a few that commit suicide over "cyber-bullying", but that doesn't make it a widespread problem.

This girl apparently already had issues with depression. This whole fake friend on the internet thing may have been hard on anyone, but most wouldn't go hang themselves over it. If people want something good to come of her death, they may look into something that may lead to more awareness and treatment of teen depression.

This is as pointless as trying to hire an internet secretary, but less entertaining.

As emcee already pointed out, this is only a "solution" for one trigger of suicide, not the root cause. Treatment for depression is much more practical than trying to stop each and every form of bullying. (Although doing both would also be good, treating depression is actually feasible and will save more lives.)

And how does this work on the Internet, or more specifically the WORLD WIDE WEB?

There's a difference between an argument and a death threat, and even if the bill passes I don't really think there'd be much of a difference... but it still ends up being that dark cloud overhead.

They can not enforce this law if there is a TOS on a website claiming that: 'moderators and admins will treat you like a shithead if you act like one. You agree that by posting here you have read this and accept any givin punishment blah blah blah'
