I'd be pissed off too if some airline lost my 360 and hard drive. That's why when I travel, I keep my memory units/devices with me.

It actually makes sense...you know, a lot of times they will be pressured to settle because they are being sued for the maximum, its actually a common and smart move. But I doubt he'll be making that 1 million :p

Most I'd want in that particular case is the cost of the XBOX and maybe a few K in terms of the suit costs and other some such.

Usually I'd keep that kind of info backed up...even on consoles...my PS3 is connected to a MAXTOR external drive that is larger than the drive, that I've replaced, and I keep backups on a regular basis.
